Trade in spirits

Article 39 of the Alcohol Act (AlkG; SR 680) stipulates that the term “trade” always applies when spirits are sold, brokered or otherwise supplied for drinking purposes.

According to Art. 41a AlkG, the cantons are responsible for all questions relating to the implementing provisions in connection with the retail trade in spirits. A list of the competent cantonal authorities can be found under ‘Further information’.

Under Article 43 AlkG, the FOIA is responsible for promoting coordination and the exchange of information between the federal government and the cantons in relation to the retail sale of spirits. The aim is to ensure that the provisions of alcohol law are enforced as uniformly as possible.

Trade restrictions

Article 41(1) of the Alcohol Act (AlkG; SR 680) sets out the restrictions on the retail sale of spirits. In summary, these restrictions concern the sale of alcohol in certain places, the sale of alcohol at reduced prices or free of charge, and the sale of alcohol to children and young people.

Retail

If distilled spirits are sold in a shop, served in a restaurant, sold online or sold on the street, a retail licence is required.

Training and resources

Sales and service staff in retail, hospitality and events are in direct contact with customers on a daily basis. They are on the front line when it comes to selling alcohol to young people and therefore have a big responsibility when it comes to prevention. They have to decide who can and cannot be sold alcohol.
